What are legal ethics?
Legal ethics refers to the principles and standards that govern the professional conduct of those involved in the practice of law, including solicitors and barristers (aka attorneys in the USA), but also witnesses, law clerks, paralegals, legal trainees and other legal staff. These ethics ensure that legal practitioners and legal professionals act with integrity, fairness, and respect for the legal system, the court, and all parties and individuals involved in legal proceedings.
Legal ethics are important because they uphold the rule of law and ensure justice is administered fairly and impartially. They protect the rights of all parties involved, maintain public confidence in the legal system, courts and judiciary, and prevent misconduct and corruption within the legal profession. By adhering to ethical standards, legal professionals and legal practitioners contribute to a trustworthy and effective judicial system.
Legal ethics and ethical preparation of witnesses are crucial for solicitors and barristers because they ensure the integrity and reliability of the evidence and testimony provided in legal proceedings. Ethical guidelines and requirements help maintain the fairness of the trial process, protect the rights of all parties involved, and uphold the credibility of the judicial system.

Key ethical obligations of a solicitor include:

  • A lawyer’s primary duty is to the court
  • Act in the best interest of your client
  • Be honest and courteous in the course of legal practice

Similar rules also apply to barristers, albeit with some subtle differences given the different nature of the profession.

 

A legal practitioner, whether a barrister or solicitor, should ensure all witnesses are prepared to give evidence in court ethically. To do this they:

  • Should not advise or suggest to the witness that false or misleading evidence should be given
  • Should not coach a witness by advising what answers the witness should give to questions asked during cross examination
  • Can express a general requirement to tell the truth
  • Can question and test in conference the evidence of the witness
  • Can draw the witness’ attention to difficulties, problems or inconsistencies in that witness’ evidence
  • Should ensure the witnesses understand their ethical obligations and the importance of honesty and accuracy in their testimony
